Brisbane’s Short-Term Rental Landscape in 2026

Short-Term Rental Landscape

Brisbane’s short-term rental sector has been through a period of significant regulatory uncertainty — and June 2026 brings important clarity for property owners across the city. Understanding where the rules currently stand is essential for anyone operating or considering a short-term rental in the Queensland capital.

Earlier in 2026, Brisbane City Council had been advancing a proposed Short Stay Accommodation Local Law that would have required permits from 1 July 2026 and asked owners in low-density residential zones to cease short-term rental operations by 30 June 2026. However, in May 2026, Lord Mayor Adrian Schrinner confirmed that this proposed local law is not proceeding at this time.

For Brisbane hosts, the practical outcome is straightforward: no new permit is required, there are no night caps, and no state short-term rental levy applies in Queensland. Brisbane currently operates as one of the most permissive major Australian capitals for short-term rental accommodation. The existing framework — including Council rates differentials, body corporate by-laws where applicable, and Queensland’s smoke alarm requirements — continues unchanged.

Outside Brisbane, the picture varies. Noosa requires development approval for short-term rental operations, and Gold Coast has its own material change of use requirements for certain properties. Hosts across Queensland should always verify requirements with their specific local council before commencing or continuing short-term rental operations.

One compliance matter applicable across the entire state is Queensland’s smoke alarm standards. All dwellings must have interconnected photoelectric smoke alarms installed in every bedroom, connecting hallways, and on each storey by 1 January 2027. For short-term rental operators, ensuring your property meets this standard ahead of the deadline is both a legal and a guest safety obligation.
